Ft. Lauderdale, FL, Oct. 4, 1991 -- A Federal Judge granted The Life
Extension Foundation and its officers Saul Kent, President, and William
Faloon, Vice-President, the return of nutrient supplements and all business
documents which the U.S. Food and Drug Administration (FDA) had seized on
February 26, 1987.  A Court Order was signed by U.S. District Judge
James C. Paine on October 1, 1991.

Jude Paine denied the government's motion for a stay of the order.

The Motion for return of The Foundation's property was filed pursuant to
Rule 41 of the Federal Rules of Criminal Procedure.

The handing down by the U.S. District Court of an order to return a
nutrition supplement company's seized products and business papers comes at a
time when the U.S. Congress is considering a proposed bill (H.R.2597) which
would, if passed, negate a business's ability to have recourse to a court of
law, except on appeal AFTER the products had been destroyed!  H.R.2597 would
empower the FDA so that any legal action brought by that agency would, in
effect, deny a business recourse to a court of law to obtain a court order
against the FDA, as happened in the case of The Life Extension Foundation,
et al.

In view of this court order (and others against the FDA in 1991),
The Life Extension Foundation recommends that Congress re-assess H.R.2597
for its denial of due process BEFORE it moves this bill along on its way
to passage into Public Law.
