Introduction:

The Norwegian parliament has instructed our government to prepare a
law outlawing the cloning of animals and the most advanced organisms.
The proposed ban on cloning of organisms of higher intelligens put
the lawmakers own intelligence in doubt, and makes one wonder if it
might still be legal to clone these government officials, (even)
after the law has been passed.

If you are in favor of cloning, please submit your arguments to:

The department of health & social services,
the office in charge of hospitals,

The office apparently does not even have an e-mail address, On the
other hand they are not attempting to regulate (other) high or
innovative technology but only attempting to write laws outlawing
it, and then they apparently don't need to be in touch (with) or up
to date (on the latest computer technology either).


STATEMENT DELIVERED TO THE HEARING REGARDING CHANGE
---------------------------------------------------
IN THE LAW ON MEDICAL USE OF BIOTECHNOLOGY.

My name is Trygve Bauge, My highest goal is to continue to be
active and highly life-extending furthermost into the future. In
that regard I find cloning, uploading of my own mental content to
that of a clone, and the linking of our minds, as one of the more
viable approaches.

When The Norwegian government in an overwhelming vote selects to
instruct our government to outlaw cloning, and calls for a world
wide ban on cloning, and Bioteknologinemda -the agency in charge of
writing the law-even announces that it considers outlawing the
taking and cryogenic preservation of cell samples for future
cloning, then I find this to be a direct threat to my own long run
survival, and a threat to the survival of those other human beings
that share my goal.

If you are going to make me a criminal and to punish me for my
virtues. Then my response will be to write a new constitution and
to organize politically so that you not only won't be able to
successfully outlaw cloning, but will be held personally liable for
the harm that your attempt is causing.

In other words: If you want to outlaw cloning or the taking and
storing of cell samples for future cloning, and to arrest me for
doing my best to extend my own life, then my response will be to
attempt to make your own action a punishable felony:

No government shall make any law regarding the cloning of human
beings or the taking and storing of cell samples for future
cloning. Each human being has the right to prosecute, convict and
jail as a felon any individual who has aided or abetted in the
outlawing of cloning or the outlawing of the taking or storing of
cell samples for future cloning, and the right to sue for and
collect from such a felon and the government he worked for, full
compensation for any harm caused by such a felony, triple punitive
damages & cost and attorneys fees for prosecuting & getting redress.



Now that we know the lines of the conflict, let us look at what you
are attempting to outlaw.

To attempt to outlaw cloning, cell taking and cell storage is like
attempting to outlaw fire, the wheel and the computer. The
technology is a reality. The genie is out of the bottle. It is not
just that you can't put it back, it would be outright unethical to
attempt.

The technology for taking, cultivating, freezing, storing, thawing
and continuing to cultivate live cell samples is simple and widely
known, as is the technology for cloning embryos.

Many laboratories around the world are working on various
approaches for how to clone specialized cells.

The innovators at the Roslin institute won the race,

I have often wondered if the precursor cells to sperm cells, the
still diploid spermatagonium cells, are the cells in an adult
organism that are closest to the genimprinting of embryo cells. And
there are laboratories that pursue a different way of cloning just
these cells than the techniques developed at the Roslin institute,
However I admit that it is easier to harvest skin cells and that a
technique that clones adult organisms from a simple skin cell seems
much easier to use.

No doubt the future will see different individuals & companies
patenting different approaches for resetting the genimprinting of
specialized cells to that of an embryo cell.

By attempting to outlaw cloning you might just make these
individuals and companies withdraw their generosity, and select to
keep their knowledge as proprietary property known only to them,
rather than patenting & licensing their achievements to the benefit
of us all.

Then you might soon have the world that you so ineptly are
attempting to outlaw: The world where only the richest and the most
powerful and ruthless or only the worlds military services get hold
of the knowledge to clone.

On the other hand why bother to react to what the Norwegian
government is doing. It is not without reason that there are more
people of Norwegian descent abroad than in Norway. As long as some
other part of the world does not outlaw cloning and the storage of
cell samples, Norwegians can have cell samples taken, stored,
cloned and brought to term while vacationing abroad.

(The world ought to ask our previous prime minister Gro Harlem
Brundtland for her views on cloning, before considering her for the
post of chief of the World Health Organization or for any other
international office.)

The world ought to ask any Norwegian seeking international office,
for the former's view on cloning before considering that person for
any international office.

The world ought to be sure that she does not take along the
Norwegian habit of politicizing everything that ought to be decided
separately by each individual, or the Norwegian attitude that
everything is outlawed that is not clearly permitted.

And in particular the world ought to beware of any attempt to
spread the Norwegian policy on biotechnology that everything is
outlawed, unless all ramifications are known, reviewed to death and
approved by a large group of bureaucrats and politicians that are
guided not by the pursuit of longevity, entrepreneurial liberty,
private property, knowledge or reason but by religion, gut feelings
and other outright irrational considerations.


The main steps in taking, separating, cultivating, freezing and

storing cell samples are:

Use a sterile scalpel. Take a cell sample that is 1 to 3 millimeter
deep and 2 to 3 millimeter in diameter. Place the tissue samples in
a sterile glass dish.

Add an enzyme called Trypsin. Let it stay until the cells are
easily separated from the glass surface, but not so long that the
individual cells are damaged.

Place the cells in a solution of 50 % Trypsin and 50% Ham's F 12
the latter is an over-the-counter medium for cell cultivation.

Let the solution go through centrifugation. Collect the cells.

Create a solution of 80-90% Ham's F 12 solution, 10% fetal calf-
serum and about 1% antibiotics. (or enough to get 100 units of
penicillin per ml)

Place the solution in a sterile syringe with a filter in the end.
Press the solution through the filter for sterilization by
filtering.

Place the solution in sterile plastic or glass containers. Add the
cells. Let the cells grow. They will multiply.

Replant the cells every 2 days: Split in smaller portions and place
in new vials. Replace the growth medium each time. And you have a
cell line you can continue to grow.

If you want to freeze the cells in such a way that these survive:
Place the solution containing the cells in plastic vials fit for
storage in liquid Nitrogen. Add enough DMSO to the growth medium so
that the total solution will contain 5% DMSO.

Place the vials in a regular freezer at minus 18-20 degrees Celsius
for about 15 minutes. Place the vials thereafter in a styrofoam box
backfilled with dry ice for about 30 minutes. The vials can
thereafter be stored at dry ice temperature (-79.5 degrees
Celsius), or even better be put in a thermos with liquid Nitrogen
(-195.8 degrees Celsius).

The above or something similar is done at many hospitals. Cells are
routinely harvested, cultivated, frozen, thawed and recultivated
for all kind of medical purposes, cancer research being one and
research on inheritable diseases another. In Norway all the
supplies called for are readily available from specialty stores
catering to hospitals or from all kind of regular stores. DMSO you
can get in some health food stores, and dry ice you can even get
from the dairy.

These are steps that most teen-agers can take in biology class, or
with some preparation, in the kitchen while their parents take a
nap.

Cloning of embryos have been done for years at Universities and
agricultural schools around the world.

Not long ago a high school glass was extracting the DNA of embryo
cells.

No doubt the process of cloning new organisms from adult cells will
be simple to practice too, once the right procedures and chemicals
are known.




The people threatening to outlaw cell taking for future cloning
might give some thought to the fact that not even a police state
will be able to enforce such a law.

How are you going to identify the purpose behind the cell taking?
Or are you going to outlaw all kind of cell taking and all the
supplies involved, forbid others than licensed stores to sell and
others than licensed individuals to buy these, and thereby create a
black marked for Trypsin, Hams F 12 and dry ice?

How are you going to prevent what anyone can do in their own garage
or kitchen?

One doesn't have to cultivate and freeze one's cell sample on one's
own. All one has to do is to use a scalpel and take the cell sample
and package it correctly so it survives being mailed abroad. How
are you going to prevent anyone from packing a simple vial, some
water and some ice in a plastic bag inside a small box and shipping
it abroad?

Or how are you going to prevent the population from going abroad to
have their cells sampled or cloned?

How are you going to catch me and others doing what we will be
doing in spite of the rights-violating law that you are trying to
impose upon us?

Are you going to take police off more serious work so that these
can close the border, open the mail and look through folks home
freezers?

And how will you prevent me from making it generally known how easy
the law can be circumvented? Will you try censorship, and how do
you plan to prevent Norwegians from accessing foreign news media or
the Internet?

And if you catch me taking and storing cell samples, or later
cloning such, so what?

Let me know what punishment you plan to give me for continuing to
assist people in taking and storing cell samples for future cloning
and I will be glad to dedicate my life to giving YOU, life in
prison for your efforts.

The only person who legally or de facto can stop the use of a
cloning technique is the individual who invented it, and even that
person can't stop others from developing alternative techniques, or
anyone from replicating how nature creates identical twins.

So much for the impracticality of enforcing a ban on cell taking
and cloning.


Now to the unethical aspects of your attempt to ban cloning:

Cloning is not about creating a monster by combining the DNA from a
reptile and a dog.

Nor is cloning about creating new deadly germs.

Nor is cloning about creating organisms resistant to antibiotics.

By cloning you do not create any new or unknown DNA combination,
you just copy an existing DNA combination.

With cloning all you do is to create a copy of a living organism
minus it mental content,





When you clone an adult human being you would create a copy of a
DNA combination that have been living for quite some time without
being a threat neither to itself or the environment.

When you already permit the creation of new DNA combinations, the
creation of new germs and the creation of organisms that are
resistant to antibiotics, actions that pose some risks, then it is
a little strange that you attempt to outlaw the copying of DNA
combinations that have a track-record of not being a threat to
themselves or the environment.

Cloning is like creating a new identical twin of a younger age.

A certain percentage of all natural births are identical twins.

If more families started having identical twins this would not be
of harm to them, nor threaten the fabric of our society.

Cloning is not about creating 3 million copies of someone in
factories, we still need mothers to carry each embryo to term. Any
country deciding to make a lot of copies of just a few people would
reduce its own genetic diversity and fall victim to inbreeding.
Besides it would have to get lots of mothers to carry to terms
someone that is not of their own flesh. And that is something that
one could only accomplish in a totalitarian society that has the
legal power to decide what kind of cloning that shall take place.
This is an argument to take away from government the power to
regulate cloning, since only a legal monopoly to regulate cloning
can cause the totalitarian scenario in the first place.

The fact that a government that regulate cloning, can cause a lot
of harm on a large scale, is an argument for securing that
individual mothers can decide for themselves what clone they want
to carry to terms.

And to ban all cloning is not the solution, because only a
government with the power to enforce a ban on cloning will have the
totalitarian power to create forced cloning on a large scale.

I don't expect cloning to be too expensive, taken into account that
there already are several ways of accomplishing it, (Embryo cloning
being one and the Roslin method being another.)

And even the cloning of adult organisms isn't likely to be too
expensive since alternative cloning techniques are under way, and
parents with some forethought already can clone their offspring
cheap at the embryo stage.

Only by regulating or attempting to outlaw cloning, will cloning be
reserved for the rich, the powerful, the intelligent and the
healthiest among us.

If we let it be up to each woman whether or not she wants to carry
a clone to term, and what clone she wants to carry to term, we will
get more than enough diversity.

In a free market as soon as we get a few thousand Elvises, the
value and demand for Elvis clones will abate.

Most human beings want children and grandchildren of their own
flesh.

Many people are not able to get children. Many have been able and
then lost the ability.

Some people die before they get children.

Some people have lost their offspring, and are no longer able to
get more.



Some people don't get children the traditional way while they still
can.

A large number of women who have used oral contraceptives are not
able to restart their monthly period.

Some people have received radiation or chemotheraphy without first
storing samples of their sperm or egg cells.

Some people are sterile, for whatever reason.

Of those women who can't get children the natural way, not everyone
can get children by artificial insemination, or by extracting,
fertilizing and reimplanting of an egg-cell.

My estimate is that if we forbid that government regulate cloning,
many average individuals and couples who are unable to get
offspring in any other way, will use cloning to get an offspring of
their own flesh and blood.

Some people who couldn't otherwise get children will get one, and a
few women will rent out their wombs repeatedly, but aside from
that, women or couples won't be getting more children than they
otherwise would. The easier it is to decide what children to get,
the fewer children one will have to get to get it right. And I
doubt that the average number of children per person will increase.

Cloning does not necessarily increase the population. It might just
change what kind of kid some women select to carry to terms. and
lead more people to get at least one kid and others to get just one
kid.

The family that just approached me for assistance in getting cell
samples taken and stored for later cloning, is just an average
Norwegian family. Not any richer nor any poorer than others, not
any more intelligent nor any less intelligent than others, nor are
they top athletes. The lady had just lost her only sibling, and can
apparently no longer get children herself, neither have kids, and
cloning seemed the best shot at getting offspring.

Other artificial methods of getting offspring already being
regulated and harder to get permission to use.

Cloning on a family basis does not necessarily reduce diversity, it
might only maintain some of the diversity that already exist.

If cloning had been around at the time of Beethoven, A younger
Beethoven might still have been around. Which is no guarantee that
he would still be writing music.

When all the immediate next of kind want cell samples to be taken
of a just deceased relative and stored, then it would be unethical
not to let them take the cell samples.

To clone a person is not any more unnatural than to give a patient
penicillin.

From the date human beings stopped walking on four legs, we have
been acting unnatural and messing with life, Most of the time the
changes have been to the better. This is what that is called
progress.

To clone is not to infringe upon life, to ban cloning is on the
other hand to infringe upon our ability to extend our lives.

And life extension is what life is all about.

Rather than trying to outlaw the inevitable, it would be more
valuable to try to make the most of it.



Let us make it easier for people to get cell samples taken while
they are alive.

Let us make it easier for people to store cell samples safely for
later cloning.

Let us make it easier for anyone to select what of one's own genes
one want one's own children to have and what genes from others one
want to add.

It will soon be possible for parents to design what genes from what
parent they want their offspring to end up with.

Well let us focus on how this can be done safely and cheaply, so
that no-one's genetic survial or blood line, any longer is at the
mercy of any opposing, politician, doctor or pathologist.
